Photographing a Criminal Prosecution Without Court Permission

Law No. 71 of 2021

The principle of public hearings is one of the well-established principles of the Egyptian legal system stipulated in the Criminal Procedural law, in which the courtroom is open to whoever wants to attend the trial proceedings, investigations, pleadings, and judgments, from the general public.

However, the court may order that all or part of the proceedings be heard in a private hearing, or prevent certain categories from attending to preserve public order or morality. Such private hearings can only be held upon the issuance of a judgment from a public hearing. Therefore means that a judge’s decision alone is insufficient, and would invalidate the proceedings.

Although public hearings allow the general public’s opinion to be aware of the trial proceedings and increases confidence in the judiciary system, it cannot by any means be misused in the pursuit of fame in a way that violates the principle of equality or brings judges to the attention of the media, which can sometimes cause confusion among the public or violate the accused’s right to a fair trial without defamation.

In light of the legislator’s policy of amending legislation to support new developments, President Abdel Fattah El Sisi issued Law No. 71 of 2021, which imposes a financial penalty of no less than EGP 100,000, and no more than EGP 300,000, for whoever photographs, records, broadcasts, publishes or presents, in any public manner, the trial proceedings of a criminal prosecution hearing without the permission of the head of the competent court, and after consulting the Public Prosecutor’s Office

Devices that are found to be used not in accordance with the above, will be confiscated, erased or destroyed, according to the circumstances, and the penalty shall be doubled in case of recidivism.

This amendment conforms to the provisions of the Egyptian Constitution, in particular, article (96/ 1st paragraph), which concludes that the accused is innocent until proved guilty in a fair trial, as well as article (187) of the Constitution, which provides that court hearings are public unless the court decides to keep them private to observe public order or morality. In all cases, the judgment shall be announced in a public hearing.

Finally, this exemplifies an unprecedented legislative shift, since it highlights the belief that every person is considered innocent until proven guilty, whilst also protecting an individuals’ right not to be photographed in a situation that makes them an object of contempt or suspicion among others.

حظر تصوير المحاكمة الجنائية دون اذن المحكمة

القانون رقم 71 لسنة 2021

مبدأ علانية الجلسات يعد من المبادئ المستقرة في النظام القانوني المصري التي نص عليها قانون الإجراءات الجنائية، ومفاده أن تكون قاعة الجلسة مفتوحة أمام من يشاء من الجمهور حضور اجراءات المحاكمة فيشمل التحقيقات والمرافعات وإصدار الأحكام.

ومع ذلك على خلاف الأصل، يجوز للمحكمة ان تأمر بسماع الدعوى كلها أو بعضها في جلسة سرية أو تمنع فئات معينة من الحضور فيها متي رأت أن مراعاة النظام العام أو المحافظة على الآداب يقتضي ذلك، ولا تنقلب جلسات المحكمة سرية الا بحكم مسبب يصدر من المحكمة في جلسة علنية، فلا يكفي قرار رئيس الجلسة بذلك والا تسبب في بطلان ما تم فيها من إجراءات.

وعلي الرغم من ان تقرير العلانية للجمهور يجعل الرأي العام رقيباً على إجراءات المحاكمة ويدعم الثقة في القضاء والاطمئنان إلى عدالته، الا انه يجب ألا يسئ استعماله والتستر خلفه سعيا وراء الشهرة بما يخل بمبدأ المساواة أو جعل القضاة محط أنظار وسائل الإعلام التي يمكن في بعض الأحيان ان تثير البلبلة بين الجمهور بين مؤيد ومعارض كما يحدث في قضايا الرأي العام او انتهاك حق المتهم في محاكمة عادلة بعيداً عن التشهير به

وانطلاقاً من السياسة التي انتهجها المشرع في تعديل التشريعات لمواكبة الظروف المستجدة أصدر الرئيس عبد الفتاح السيسي القانون رقم 71 لسنة 2021 والذي فرض غرامة لا تقل عن مائة ألف جنيه ولا تزيد على ثلاثمائة ألف جنيه كل من صور أو سجل كلمات أو مقاطع أو بث أو نشر أو عرض بأي طريق من طرق العلانية لوقائع جلسة محاكمة مخصصة لنظر دعوى جنائية دون تصريح من رئيس المحكمة المختصة بعد أخذ رأى النيابة العامة

ويُحكم فضلاً عن ذلك بمصادرة الأجهزة أو غيرها مما يكون قد استخدم في الجريمة، أو ما نتج عنها، أو محو محتواها، أو إعدامه، بحسب الأحوال، وتُضاعف الغرامة في حالة العـود.

ويأتي هذا التعديل متفقاً مع أحكام الدستور خاصة المادة (96/ فقرة أولى) والتي تتضمن أن المتهم بريء حتى تثبت ادانته في محاكمة قانونية عادلة، وكذلك المادة (187) منه والتي تقضي بأن جلسات المحاكم علنية إلا إذا قررت المحكمة سريتها مراعاة للنظام العام، أو الآداب، وفي جميع الأحوال يكون النطق بالحكم في جلسة علنية.

في النهاية فإن هذا التشريع يعتبر نقلة تشريعية غير مسبوقة ذلك ان الأصل في الإنسان البراءة، وهذا الأصل يتمتع به كل متهم حتى يصدر ضده حكم بات على نحو يجعل له الحق في ألا تلتقط له أيه صورة في وضع يجعله محل ازدراء الآخرين أو شكوكهم.
